Court orders Comium to resume operations

The high court in Banjul has ordered Comium Gambia Limited to resume full operations forthwith pending the hearing and determination of a writ of prohibition filed

before the court.

Justice Ebrima Jaiteh made the order yesterday in a ruling on an ex-parte motion filed by Comium against the Minister of Information & Communication Infrastructure as first respondent and the Public Utilities Regulatory Authority (Pura) as the second respondent.

The judge also issued a restraining order against the minister and Pura “whether by themselves, their servants, agents or howsoever…from doing anything that would affect the subsistence and validity of the operational licences issued to Comium on the 8th May, 2006 pending the hearing and determination of the writ for an order of prohibition”.

The court granted Comium seven days to file a writ of order

of prohibition to stop the respondents from further suspending and revoking their operation licences.

Justice Jaiteh stated  he was satisfied that the application filed by Comium has merit to warrant the intervention of the court to preserve the status quo before suspending Comium’s licences in the interest of doing substantial justice in the matter. The matter was adjourned to 9th November for mention.
