Messrs Mamarr Sowe, Alieu Sarr and Modou Lamin Bittaye, are being separately tried on charges of ‘unnatural behaviour’. They pleaded not guilty and have been in detention since November last year.
Ruling on the defence lawyers’ bail application, Justice Simon Abi, said the offence of ‘un-natural behaviour’ is bailable, noting that the accused persons have shown ‘concrete’ reasons why they should no longer be kept under custody.
He ordered them to provide a bond in the sum of D1 million each to secure their release.

The court further conditioned the accused persons to surrender all their travelling documents and to report to the high court registrar every Monday and Tuesday.
