Sillaba Samateh filed a motion on notion and declared that the judgment was default that the trial was conducted in his absence as he never participated in the trial.

In his supporting affidavits, Sillaba said he was away from the Gambia continuously from 2010 to 2017 when he visited the country for the first time.

He further argued that he was forced to run away from the Gambia in June 2010 in order to save his life as he was on the verge of being killed by former president Jammeh.
