Businessman defends claim against GACH

Business tycoon, Samba Mara yesterday testified before the High Court in defence of his claims against the GACH Global Trading Company Limited.

Samba Mara is claiming the sum of D49,000.00 being outstanding balance due and owing him in respect of the rental of two trucks at a daily fee of D9500 for each truck.

He is also claiming the sum of D142,000.00 being cost of repairs of the said trucks as a result of damages caused to the vehicles by the defendant and general damages.

Samba Mara testified that he is into hiring trucks and transportation of sand and stones and wishes to rely on his re-sworn affidavit and the exhibits presented to the court as his evidence.

Responding to questions posed to him during cross-examination by lawyer P. A Mendy representing GACH Global trading Company Ltd, Samba Mara told the court that he entered into contract with GACH on 7 July, 2019.

He said GACH took possession of his two trucks to work in Basse (URR) and they agreed to pay the sum of D9,500 per day for each truck.

He denied having any agreement with the defendant to take care and maintenance of the trucks.

He maintained that the defendant was in control of the truck drivers and that it was the defendant that was supposed to pay the drivers under the contract terms.
