IEC appeals court decision on Mai Fatty

The Independent Electoral Commission (IEC) has filed an appeal before the Gambia Court of Appeal challenging the recent decision of Justice Amina Saho-Ceesay in the nomination of Ahmed Mai Fatty.

According to the notice of appeal, the presiding judge erred when she declared that the procedure adopted in the nomination of Ahmed Mai Fatty did not comply with the provisions of the Electoral Act Cap 3:01, laws of The Gambia.

In the appeal, the IEC further argued that it has complied with the provisions of the Electoral Act in the nomination of presidential candidates and political parties in the just concluded presidential election held on the 4th December 2021.

IEC is therefore seeking the Appellate court jurisdiction to overturn the decision of Justice Amina Saho-Ceesay which ruled that IEC acted outside the laws in rejecting Fatty’s nomination.
