The Brikama Magistrates’ court yesterday convicted and sentenced one Samba Jamanka to a mandatory jail term of 10 years after finding him guilty on a single count of raping a 7-year-old girl.
Mr Jamanka was found culpable for intentionally having carnal knowledge with a 7-year-old-girl in August 2018, at Brikama.
Passing judgment, Magistrate Joof said the prosecution has proven its case against Mr Jamanka, adducing evidence through 6 witnesses as well as tendering 3 exhibits comprising a cautionary statement, an IPO’s report and a medical report.
The magistrate said the convict gave a sworn oral testimony as defence witness number One. The trial magistrate further told the court that the convict did not call any other witness and neither did he tender any exhibit.
“In light of the above, I hold as a fact that it was the convict who raped the victim and I resolve the issue in favour of the prosecution. I found the convict guilty of the charge of rape and I will give the minimum sentence.
In this regards the convict Samba Jamanka is therefore sentenced on the single count charge of rape contrary to section 3 (1) (d) and punishable under section 4 (1) paragraph (a) (1) of the sexual offence Act 2013 to 10 years in prison without a fine.”
Meanwhile Police prosecutor 4906 Bangura applied to the court for the convict to compensate the victim’s injury and trauma in the sum of D200,000 which was granted by the magistrate.
