Magistrate Peter Adoh Che of the Brikama court has transferred the murder case involving Omar Trawally, who is accused of killing one Mama Baginka at Lamin Daranka.
According to the indictment, Mr Trawally on 5 December caused the death of one Mama Baginka by hitting her with a stick on her head.
Mr Trawally denied any wrong doing.
In his application for the case to be transferred to the Special Criminal Division of the High Court, police prosecutor ASP Buteh Sawaneh told the court that the charge is murder which is a capital offence, hence the application for transfer.
ASP Sawaneh further submitted that the offence of murder is equally not bailable.
“I am applying that this case be transferred to the High Court pursuant to section 62 of the CPC and accused be remanded under section 208 (A), pending his arraignment before the High Court,” prosecutor Sawaneh urged.
The trial magistrate Che consequently transferred the case to the High Court and ordered that the accused be remanded in custody.
