Court to rule on Yanks’ immunity

Justice Ebrima Ba Jaiteh of the High Court in Banjul yesterday adjourned the criminal matter involving the state against Yankuba Touray on his constitutional immunity to 2 November, 2020 for ruling.

Justice Jaiteh’s adjournment came after lawyer A. Sissohor, Yankuba Touray’s lawyer raised constitutional immunity whilst he was still testifying in his defence.

Yankuba Touray is being tried for the murder of his former cabinet colleague, Ousman Koro Ceesay, former finance minister in 1995.

During his testimony as 3rd defence witness, his lawyer raised constitutional immunity and wants the High Court to invoke it and discharge him.

Both state and the defence lawyers raised issues concerning provisions in the 1995 Constitution which prompted the trial judge to request for the original copy of the 1997 Constitution.

Justice Ebrima Ba Jaiteh informed the court that Barrister Lamin J. Darbo of Dabanani Law Chambers has provided the court with the original copy of the 1997 Constitution before the amendment in 2001.
