One Sainey Kanteh of Bakau was yesterday arraigned at the Kanifing Magistrates’ Court for the murder of one Babucarr Krubally.
According to the indictment, Sainey Kanteh on 13th January at Bakau Wasulung Kunda unlawfully and maliciously caused the death of Babucarr Krubally by stabbing him with a broken bottle in his rib.
The accused pleaded not guilty before Magistrate M Faal.
In his application for the case to be transferred to the Special Criminal Division of the High Court, the police prosecutor Chief Inspector Touray told the court that the charge is murder which is a capital offense, hence the application for transfer.
He further submitted that the offense of murder is equally not bailable.
“I am applying that this case is transferred to the High Court pursuant to section 62 of the CPC and accused be remanded under section 208 (A), pending his arraignment before the High Court,” the prosecutor urged.
The trial magistrate consequently transferred the case to the High Court and ordered that the accused be remanded in custody.
