Sabally’s appeal against Janneh commission report starts

The Gambia Court of Appeal, presided over by Justice Awa Bah, Justice O.MM Njie and Justice B.V.P. Mahoney yesterday ordered lawyer A. Fatty, counsel for Momodou Sabally to properly advise himself on the appropriate steps to take concerning the motion and appeal filed before the said court.

Momodou Sabally had filed an appeal and a motion before the Gambia Court of Appeal challenging the adverse findings of the Commission of Inquiry.
The commission recommended amongst others that Momodou Sabally who served as the Secretary General and minister for presidential affairs under Jammeh be banned from holding public office for ten years.

During yesterday’s sitting, his lawyer told the court that his client seeks to stay the execution of the adverse findings of the said Commission.
He pointed out that Sabally needs time to file the necessary processes in light of the recommendation of the Government White Paper.
Lawyer Fatty said they would advise themselves and respond properly and he therefore applied for time to do so.

The President of Court of Appeal, Justice Awa Bah adjourned the matter to 20 November, 2019 to enable Counsel Abdoulie Fatty to advise himself and to report accordingly their position on the matter.

Similarly, the Court of Appeal presided over motions filed by Ansumana Jammeh, brother of the former president Yahya Jammeh, Feryal Diab and Trust Bank (Gambia) Ltd to stay executions on the findings of the Commission of Inquiry.
