Commission could warn SCB boss if….

Commission counsel, Amie Bensouda yesterday intimated that she would apply for a warning to be issued to the managing director of Standard Chartered Bank if he fails to appear before the commission today.
Counsel Bensouda made the remark after the managing director of the bank failed to appear on Tuesday and Wednesday despite summons delivered to the secretary of the bank.

The SCB boss is summoned to shed light on the sale of Kairaba Beach Hotel as well as the sale of Agro Oil Company Limited which the bank was part of as indicated by scores of witnesses summoned by the commission.

Meanwhile lawyer Loubna Farage, a private legal practitioner was yesterday summoned in her capacity as the secretary of Gam Petroleum Storage Facility on the company and its storage facility.
Testifying before the commission, Loubna said she never had the original copies of the company incorporated certificate but rather she had some of the documents of the company.
Lawyer Farage however stated that she would tender the documents she has but objected to produce the documents that were in the custody of the company.

She was however told that she will be given time to produce the documents she said they were not in her possession. Ms Farage said she has to seek the permission of the company to produce the documents, further stating that she has the shares certificate.

She added that the shareholders were Amadou Samba, Mr. Bazzi, Mr. Mazegi, GPA, GNPC and SSHFC. She said Gam Petroleum is an offshore company which used to have shares in the Gambian company. According to her she was not the lawyer who incorporated the company further stating that in 2008 Gam Petroleum was restructured and that was when the Gambia offshore company was incorporated.

According to Barrister Farage in 2009, Mr. Bazzi and Samba transferred shares to the offshore company as Bazzi owns 99% share while Samba owns 1% share in the storage facility; adding that she does not have documents authorising the closure of Gam petroleum Limited.
The resolution of Gam Petroleum Storage Facility was in her custody and there were share transfers from Mr. Mazegi to Mr. Samba and from Bazzi to SSHFC.

Barrister Farage further testified that there was a resolution of transfer and cancellation of shares and that Gam Petroleum Storage Facility Company was incorporated since 2003.
However, Ms Farage disclosed that there was no resolution for the transfer of shares but Bensouda intimated to her that she was expected to produce the resolution of 2008- 2009 among others.
