Magistrate Muhammed Krubally of the Brikama court yesterday struck out murder charges against a 16-year-old boy [name withheld]owing to lack of diligent prosecution.
The teenager was charged with a single count for the murder of Ebrima Saho, whom he was accused of stabbing with a pair of scissors on his head .
In delivering his ruling, Magistrate Krubally said since the case was filed on 17 December 2019, it could not proceed and the prosecution gave several excuses for adjournment.
The magistrate opined that there is public expectation that there should be an end to litigation. “And since the alleged child offender is presumed innocent until proven guilty, this court has no option but to strike out this matter and discharge the alleged child offender,” Krubally stated.
According to the bill of indictment, in October 2019, the accused “with malice aforethought intentionally and unlawfully caused the death of one Ebrima Saho by stabbing him with a scissor [sic] on his head” at Brufut, Kombo North.
